$4.5M Settlement Reached In Death Of College Student From Westchester

The family of a 21-year-old college student from Westchester who was accidentally shot and killed by a police officer off Hofstra University's campus more than four years ago has reportedly reached a $4.5 million tentative settlement with Nassau County.

Andrea Rebello of Tarrytown, a junior at Hofstra, was killed by a single bullet to the head during an overnight armed home invasion in May 2013, prompting a pair of lawsuits by her family.

The settlement is expected to be unanimously approved by the Nassau legislature on Monday, according to Newsday.

Nikolas Budimlic, a Nassau County police officer, fired the shot that killed Rebello during a standoff with a 30-year-old masked and armed ex-con named Dalton Smith of Hempstead, who had broken into Rebello's home and used her as a human shield.

Jessica Rebello, Andrea's twin, who was also present when the home invasion happened on California Avenue in Hempstead, was not injured. Smith was killed during the incident which stunned the Hofstra community just days before graduation ceremonies.

A 2014 review of the incident by the  Nassau district attorney's office determined Budimlic was justified in using deadly force in the shooting and ruled out criminal charges against him.

Rebello, a junior, was majoring in public relations. She was a graduate of Sleepy Hollow High School.
