Mamaroneck Resident Charged With DWI In Scarsdale

SCARSDALE, N.Y. – A Mamaroneck resident was arrested in Scarsdale on Sunday after drinking several beers too many at a restaurant in White Plains and attempting to drive home.

According to the police report, shortly before 5 a.m., Nelson DeLeon-Lopez, 39, was stopped on Mamaroneck Road near the intersection with Secor Road. The suspect failed all of the standard field sobriety tests, moving his head during a horizontal gaze test, struggling during a walk and turn test and he couldn’t stand straight when prompted to lift one of his legs.

Police noticed the scent of alcohol on his breath, and DeLeon-Lopez refused to submit to a Breathalyzer test. Officers arrested him, charging him with moving from a lane unsafely and driving to the left of pavement marking, each infractions. He was additionally charged with driving while intoxicated and aggravated DWI for having more than .18 grams of alcohol in his system, both misdemeanors.

After 5:30 a.m., police were able to administer a Datamaster test, which showed his blood alcohol content was .24 percent, triple the legal limit. DeLeon-Lopez was released the next morning and is due back in court on Wednesday.
