At approximately 6:15 p.m. on Friday, March 31, police were dispatched to Garth Road, near the intersection of Popham Road, where there was a vehicle reportedly parked in the northbound lane, obstructing the flow of traffic.
Upon arrival, responding officers approached the vehicle, tapping on the window and telling the driver - who would later be identified as 52-year-old Ardsley resident Bradley Brehm - who was “fumbling with his hands,” to open the window according to the police report. Brehm allegedly attempted to unlock his door as many as 10 times before finally opening it, when police reported a strong odor of alcohol coming from the vehicle.
According to police, Brehm stated that he was on his way home when asked by the officers. When prompted for his identification, Brehm removed a glass of clear liquid from between his legs, placing it on the center console. The beverage would later be identified as vodka and there was an empty bottle in the passenger's seat.
While speaking with the officers, police said that he could not answer simple questions and initially would not consent to perform Standardized Field Sobriety Tests, refusing to exit his vehicle. After relenting and exiting the vehicle, Brehm stumbled and needed to use the vehicle as support. He was then unable to perform any tests, as he was “so unsteady on his feet” that police stopped them “in fear that (Brehm) would fall and injure himself.” Officers also reported that Brehm had “slurred speech, red and watery eyes and swayed continuously.”
Police subsequently arrested Brehm for driving while intoxicated. While attempting to place him in the car for transport to Scarsdale Police Headquarters, the arresting officer reported that Brehm was unable to get his feet inside the vehicle, and when he attempted to help him, Brehm tried to kick him. The officer evaded the attack and was able to secure Brehm in the patrol car.
After being put in a holding cell, Brehm was uncooperative and refused to answer questions, claiming he was “100 feet tall and his weight was 60 feet,” police said. Brehm eventually agreed to take a breath test more than an hour after his arrest, and it returned a reading of .30 percent, nearly quadruple the legal limit.
Brehm was charged with misdemeanor counts of driving while intoxicated, third-degree assault, obstructing governmental administration, resisting arrest and aggravated driving while intoxicated for having a blood alcohol content greater than .18 percent. He was also charged for parking his car illegally on Garth Road, having an open container in his vehicle and refusal to take a breath test, all infractions.
After being arraigned, police noted that Brehm was given the opportunity to contact a friend or family member to produce bail money. Instead, Brehm was remanded to the Westchester County Jail in lieu of $500 cash or bond. He is due back in Scarsdale Village Court on Wednesday, April 5.
