Westchester County District Attorney Anthony Scarpino, Jr. announced on Wednesday that Daniel Thomas Jones, 27, has been sentenced as a second violent felony offender following a guilty plea in regards to the death of Arturo Arias Garcia in November 2015.
Jones was sentenced to 20 years in prison, plus five years of post-release supervision on a felony manslaughter charge, 20 years for first-degree robbery and 15 years on each of two counts of second-degree robbery, all felonies.
Scarpino said that the sentences will run concurrently with each other but consecutively to any undischarged period of parole from an earlier crime.
According to investigators, at approximately 2:50 a.m. on Nov. 25, 2015, Jones and two other co-conspirators approached two men in a pickup truck located in the Stop & Shop parking lot in Port Chester, assaulting and robbing the two men, stealing wallets, an iPhone, cash and a bank card. Both of the victims were later treated for head injuries that required medical treatment during the incident.
Three days later, at approximately 4:40 a.m. on Nov. 28, Garcia was approached by Jones on Abendroth Avenue in Port Chester, when he struck him in the head, stealing Garcia’s cash and credit card. Garcia was found motionless on the sidewalk a half hour later, and he was later pronounced dead by paramedics at approximately 5:40 a.m. that morning.
An autopsy determined that Garcia died from blunt force trauma to the head, resulting in a fatal concussion that was delivered by Jones. An extensive investigation by local police and the District Attorney’s Office led to Jones, who was subsequently arrested. He is now under the jurisdiction of the New York State Department of Corrections.
