Mamaroneck Pine Street Residents in Uproar

MAMARONECK, N.Y. – Pine Street residents are outraged over an affidavit asking for a restraining order to ban them from entering a construction site and almost access to  their homes as well.

“First we were asked to stay back 500 feet from the construction zone, but then it was scaled back to 100 feet from the construction area.  But it’s hard to stay outside of the construction area; I live in the construction area,” said Nora Lucas, a Pine Street resident, at the village Board of Trustees meeting.  “It’s not a moot point when you have to go to court thinking you may be told, while your daughter is in the middle of her middle school exams, that you may have to leave your house.”

According to attorney Linda B. Whitehead, who was sitting in on Monday night’s meeting for Village Attorney Charles A. Goldberger, an original draft affidavit made an error and stated that residents had to stay back 500 feet from the construction site, but it was changed to 100 feet once they realized that the order included their homes.

“The village manager received a complaint from the contractors that there were people hovering over the work site. They were unsafe; they were taking pictures and were asking the workers questions that they might not necessarily know the answers to,” said Whitehead.

Development has been an ongoing issue on Pine Street for more than a decade.  The most recent action has been a lawsuit against the Village of Mamaroneck by Lucas, Charles Morelli and Stuart Tiekert, all village residents, who were concerned for the environmental impact of construction on the Tompkins Farm Oak Tree. The tree is a historic landmark in Rye Neck and sits across from Pine Street.

“I will help you personally, but you will not jeopardize the life of our tree,” said Morelli said at Monday night’s meeting.
