Andrew Rubin, Powell's attorney, confirmed the investigation had been dropped since there was insufficient evidence to bring any charges.

"The whole thing is over as far I am concerned," Rubin said.

Powell, who owns Powell Catering in Harrison, was the former treasurer of the fire department before he was removed in May 2016 by the elected wardens of the department. The wardens had asked the DA's office and Harrison police to investigate the department's financials.

"He's happy with the result, it's the result he always expected because he had done nothing wrong," Rubin said. "It's a shame, he had given a lot of years to the fire department. I'm not sure if he wants to go back."
